The right to statutory protection against unfair dismissal is given to all employees with one year’s length of service. However, there are a number of claims that do not depend on length of service, for example, sex or race discrimination.


The damages for unfair dismissal can be considerable even though they are capped. Of the claims that are not dependent on length of service, the damages are often uncapped. This means that making mistakes can be extremely costly.
